Australia has introduced important changes to Student Visa (Subclass 500) and Student Guardian Visa (Subclass 590) application rules from 2 October 2026.
The new rules affect some international students and temporary visa holders who want to lodge a Student visa application while they are already in Australia. They also introduce significant changes regarding family members, further Student visa applications and whether applicants need to be outside Australia when applying.
If you are planning to study in Australia, extend your current studies, change courses or apply for another Australian Student visa, understanding these new requirements is important before making financial, study or travel decisions.
At Bookbrite Study Abroad Advisers, we help international students understand their study options, university admissions and Australian visa requirements so they can plan their next step with greater clarity.
What Changed for Australian Student Visas on 2 October 2026?
From 2 October 2026, Australia changed the rules governing who can lodge and be granted a Student Visa Subclass 500 or Student Guardian Visa Subclass 590 while physically present in Australia.
Under the new rules, most affected temporary visa holders must be outside Australia when they lodge their Student or Student Guardian visa application.
Where the offshore requirement applies, the applicant must also generally be outside Australia when the visa is granted.
This means students should carefully check their eligibility before enrolling in another course, accepting an offer, making significant financial commitments or submitting another visa application.
Can Temporary Visa Holders Apply for a Student Visa While in Australia?
For many affected temporary visa holders, the answer has changed.
From 2 October 2026, most affected temporary visa holders who want to apply for a Student Visa Subclass 500 or Student Guardian Visa Subclass 590 must lodge their application from outside Australia.
If the offshore application requirement applies to you, you must also be outside Australia when your Student visa is granted.
Students should therefore avoid assuming that holding another temporary Australian visa automatically allows them to move onto a Student visa while remaining in Australia.
Your current visa subclass and individual circumstances need to be checked before lodging an application.
New Rules for Current Student Visa Holders
The changes are particularly important for students who already hold a Student Visa Subclass 500 and are considering another course or extending their studies.
Under the new system, a current Student visa holder will generally need to apply from outside Australia for another Student visa unless they meet one of the limited exemptions.
This can affect students who are:
- Completing their existing course and planning another qualification
- Changing courses
- Changing education providers
- Extending their studies
- Moving from one level of study to another
- Planning a second Australian Student visa
Your existing Student visa is not automatically cancelled because of these changes. However, the rules governing your next Student visa application may be different.
Who May Still Be Able to Apply for Another Student Visa in Australia?
Some current Student visa holders may still qualify to apply while they are in Australia.
Examples of circumstances where an exemption may apply include students who:
- Need up to an additional 12 months to complete their existing main course with the same education provider
- Are sponsored by the Department of Foreign Affairs and Trade or Defence
- Are applying to undertake a PhD
- Are applying for primary or secondary school studies
- Have completed their main course and are progressing to an eligible course at a higher Australian Qualifications Framework level
- Are progressing between certain AQF and non-AQF courses
- Cannot continue studying because their education provider has defaulted
The exemption rules are specific, so students should not assume they qualify simply because they are continuing their education in Australia.
Important Rule for Student Visa Dependants
There is also an important change for people currently holding a Student visa as a dependant.
If you hold a Student visa as a dependant and want to become the primary Student visa applicant, you must lodge your application from outside Australia and be outside Australia when the visa is granted.
According to the current Department of Home Affairs guidance, there is no exemption to this particular requirement.
Major Changes to Family Members on Student Visas
One of the most significant parts of the Australia Student Visa changes in 2026 relates to partners and dependent children.
Under the new rules, Student visa applicants generally cannot include family members such as a spouse, partner or dependent children in their Student visa application unless an exemption applies.
There are limited exemptions for certain categories of students, including some:
- PhD students
- DFAT or Defence-sponsored students
- Foreign government scholarship recipients
- Eligible students from Pacific countries
- Eligible students from ASEAN member countries
Other limited circumstances may also apply depending on the student's existing visa and course situation.
Can Family Members Join a Student Later?
This is another major change international students need to understand.
Current Student visa holders generally cannot add family members as subsequent entrants after their Student visa has already been granted.
The Department of Home Affairs states that there are no exemptions to this general subsequent entrant restriction.
This makes family planning an important part of the Student visa process.
Students who have a spouse or dependent children should understand the family eligibility rules before lodging their application rather than assuming that family members can simply be added later.
What If My Student Visa Application Was Lodged Before 2 October 2026?
If you lodged your Student visa application before 2 October 2026, it will generally continue to be assessed according to the rules that applied when you submitted the application.
This also applies to applications lodged before the commencement date that already included eligible family members.
Therefore, the date on which your application was lodged is particularly important when determining which rules apply.
What Happens If You Apply in Australia When You Are Required to Be Offshore?
Students need to be especially careful about this point.
If you are required to apply from outside Australia but lodge the Student visa application while you are inside Australia, the application may be considered invalid.
An invalid application can create additional immigration complications, particularly if your existing visa is approaching expiry.
For this reason, it is important to confirm your eligibility before submitting a Student visa application.
Can You Return to Australia While an Offshore Student Visa Is Processing?
In certain circumstances, a person who has lodged their Student visa application from outside Australia may return to Australia using another valid visa while the Student visa application is being processed.
However, if the new rules require you to be offshore for the Student visa grant, you must again be outside Australia when the Student visa is granted.
An offshore Student visa application also does not provide a Bridging visa simply because you have lodged the application.
Travel planning therefore needs to be considered carefully.
How Do the Changes Affect Students Planning to Change Courses?
Students already studying in Australia should check their visa position before changing courses or accepting another offer.
For example, moving into another program may require a new Student visa. Depending on the type and level of the new course, you may or may not meet an exemption allowing you to apply from within Australia.
Before changing your course, consider:
Your current visa expiry date
Check how long your existing Student visa remains valid.
Your current course and provider
Certain exemptions depend on continuing with the same education provider or completing an existing course.
The AQF level of your next course
Course progression can affect whether you qualify for an exemption from the offshore application requirement.
Whether a new Student visa is required
Do not assume that receiving a new Confirmation of Enrolment automatically means you can lodge another Student visa while remaining in Australia.
Travel requirements
If you are required to lodge offshore, travel costs and timing may need to become part of your study plan.
What Is the Australian Qualifications Framework?
The Australian Qualifications Framework (AQF) classifies Australian qualifications across different levels.
It is particularly important under the new Student visa rules because some students progressing to a higher AQF-level qualification may meet an exemption allowing them to lodge another Student visa from within Australia.
Students considering further study should therefore compare the AQF level and type of their current qualification with their proposed next course.
Student Guardian Visa Subclass 590 Changes
The changes also affect the Student Guardian Visa Subclass 590.
Most affected temporary visa holders must now be outside Australia when lodging a Student Guardian visa application and when the visa is granted.
However, current Student Guardian Visa Subclass 590 holders can continue to lodge a further Student Guardian visa application while in Australia.
Applicants should still check their circumstances and the latest Department of Home Affairs requirements before lodging.
What International Students Should Do Now
If you are currently studying in Australia or planning to study in Australia in 2026 or 2027, review your study and visa strategy before making your next move.
Students should:
- Check the expiry date and conditions of their current Australian visa.
- Confirm whether they can lodge their next Student Visa Subclass 500 from inside Australia.
- Check whether an exemption applies to their circumstances.
- Review the AQF level of their current and future course.
- Consider offshore application and travel requirements.
- Review the new family member rules before planning to include a spouse or dependent children.
- Avoid making major financial commitments until their visa pathway is clear.
- Ensure their course, Confirmation of Enrolment, financial documents, health insurance and other Student visa requirements are properly prepared.
